Traffic Stop: Pedestrian Right Of Way

Kansas statute says, drivers "shall yield the right-of-way, slowing down or stopping if need be to ...yield, to a pedestrian crossing the roadway within a crosswalk".

In addition, while pedestrians have an obligation to cross in a way not so “suddenly” or “close” as to "constitute an immediate hazard."

Drivers bear the burden of being aware of and watchful for those who enter the street.

Essentially, EVERY corner is a crosswalk regardless of whether paint, a sign, or a crossing guard indicates it.

SLOW, STOP, & YIELD -EVERY time. Failure to do so is a moving violation. In McPherson, the fine is $60, plus $78 Municipal Court Cost.
